Terms of Service

These terms cover your use of The Marquee, a platform operated by Ai Boulder Mountain Tech. They are written in plain English on purpose. If anything here is unclear, email info@bouldermountaintech.com and ask — we would rather explain it than rely on you not reading it.
1. Who we are
The Marquee (“the Platform”, “we”, “us”) is operated by Ai Boulder Mountain Tech. You can reach us at info@bouldermountaintech.com for any question about these terms, your account, or your data.
2. What The Marquee does
The Marquee is software. It gives you (the “Organiser”) a storefront where you can list events, sell tickets, sell products, publish posts and collect leads. We host that storefront, process the technical side of checkout, issue tickets, and send transactional email on your behalf.
We do not promote your events, guarantee attendance, or take part in what you sell.
3. Who is actually selling — read this one
In practical terms this means you are responsible for the event or product actually being delivered, for refunds and cancellations, for any tax you owe on the sale, and for answering your buyers. If an event is cancelled, the obligation to make it right sits with you, not with us.
We take a service fee on each transaction (section 5) for providing the software. That fee does not make us the seller, and it does not transfer any of the above to us.
4. Accounts and workspaces
- You must be legally able to enter a contract, and you must give accurate account information.
- You are responsible for activity under your account and for keeping your login credentials safe.
- You are responsible for your content — your event listings, product descriptions, images and posts — and for having the rights to use them.
- You keep ownership of your content. You grant us only the licence needed to host, display and deliver it as part of running the Platform.
5. Fees
There are two separate charges, and they work differently.
Membership is what you pay us for the software: Host $19/month, Headliner $49/month, Producer $99/month. Every plan starts with a 15-day free trial. Membership is billed monthly in advance through our payment provider.
Transaction fees apply per sale, on every plan including during the trial:
- Tickets — 3% + $1.25 per ticket order
- Products — 2% + $0.30 per product order
These are our fees. Stripe charges its own separate processing fees on top, under your agreement with Stripe. Transaction fees are disclosed at checkout before a buyer pays.
6. Refunds and cancellations
For your buyers: you set your own refund policy and you issue refunds. Buyers should contact you, not us. When you refund an order through the Platform, our transaction fee on that order is returned too — you are not left paying a service fee on a sale that did not stand.
For your membership: you can cancel at any time. Cancelling stops future billing; your access continues until your current paid subscription ends, and then your workspace reverts to the free tier. Cancelling during the 15-day trial costs nothing. We do not pro-rate partial months, but if something has gone genuinely wrong, email us — we would rather sort it out than argue about it.
7. Acceptable use
You may not use The Marquee to:
- sell anything illegal where you or your buyers are, or anything you are not licensed to sell;
- defraud buyers, including selling tickets to events you do not intend to hold;
- infringe someone else’s copyright, trademark or likeness;
- send unsolicited bulk email through our sending tools;
- attempt to access other tenants’ data, probe our systems, or work around technical limits.
We may suspend or close an account that breaks these rules. Where we reasonably can, we will tell you why and give you a chance to fix it first — unless doing so would prolong harm to buyers.
8. Custom domains
Headliner and Producer plans can serve a storefront on your own domain. You own and pay for the domain and you are responsible for its DNS. Domain setup is currently arranged with us directly rather than self-serve, and we cannot guarantee a timeline for a domain we do not control.
9. Availability
We work to keep the Platform up but we do not promise uninterrupted service. Hosting, database and payment infrastructure are provided by third parties (see our Privacy Policy), and outages there can affect us. We recommend not scheduling your only door-scanning device on an unreliable connection.
10. Liability
The Platform is provided “as is”. To the fullest extent the law allows, Ai Boulder Mountain Tech is not liable for lost profits, lost sales, or indirect or consequential damages. Where liability cannot be excluded, our total liability to you is limited to the membership fees you paid us in the twelve months before the claim.
Nothing here limits liability for fraud or for anything else that cannot lawfully be limited.
11. Changes
We may update these terms as the Platform changes. Material changes will be announced by email to account owners, and the “last updated” date above will change. Continuing to use the Platform after that means you accept the revised terms.
12. Governing law
These terms are governed by the laws of the State of Colorado, United States, without regard to its conflict of laws rules. Any dispute will be brought exclusively in the state or federal courts located in Denver County, Colorado, and you and Ai Boulder Mountain Tech each consent to the personal jurisdiction of those courts.
